i. Acknowledgement, Waiver and Release

Attention all participants:

The following statement affects your legal rights including your right to sue. All participants whom participate in an event with Rideo must read all of this statement, and the rest of the terms and conditions thereafter, to ensure they fully understand and are clear on their legal position when participating in any event and furthermore must accept the following conditions and acknowledge this when registering for the event.

“Rideo” means Capsta Enterprises Pty Ltd (ACN 659475519) trading as Rideo Mountain Biking and is the organiser of the Event and includes its directors, secretaries, officers, employees, partners, contractors, volunteers, representatives, sponsors and agents. 

“Claim” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising including but not limited to negligence.

“Commencement Time” means the time and date for when an Event starts. If there is more than one lesson as part of an Event, the commencement time is the time and date of the first of those lessons.

“Courses and Programs” means any Event that includes more than one lesson.

“Event” means any bike riding or associated activities, where for payment or not, and includes but is not limited to bike racing, bike coaching sessions, skills instruction sessions, private coaching sessions, social rides, mechanical sessions, ramp building and other similar related activities. Where there is more than one lesson as part of a course or program, the Event is the collection of all those lessons and connected activities forming that course or program.

“Participant” means any person engaging in an event, including travelling to and from the event, and also includes any person registered in an event.

“Shred Squad Mountain Bike After School Program” means any kids after school program.

You, the participant, agree that you are medically and physically fit and able to participate in the event. You acknowledge that you must, and agree that you will, disclose any pre-existing medical or other condition that may affect the risk that either they or any other person will suffer injury, loss or damage. You acknowledge that the Rideo relies on information provided by you, and that all such information is accurate and complete.  You acknowledge that mountain biking and the event is inherently dangerous. Participants recognise that there are risks specifically associated with the event which include, but are not limited to, collisions and contact with other participants, the remoteness of the areas in which an event takes place, sudden and unexpected changes in weather, physical exertion and difficulties in evacuation if you become disabled. You acknowledge that accidents can and often do happen which may result in you being injured or even killed, or your property being damaged. You understand and acknowledge the dangers associated with the consumption of alcohol or any mind‐altering substance before or during the event, and you accept full you responsibility for injury, loss or damage associated with the consumption of alcohol or any other mind-altering substance.  You agree to follow any rules set by Rideo in connection with the event. In particular, you have been advised to wear an approved helmet at all times during the event. If you fail to comply with Rideo rules and/or directions, you will not be permitted to participate or to continue to participate and no refund will be given.  In consideration of being allowed to participate in the event, you (on your own behalf and on behalf of your executors, administrators, heirs, next of kin, successors and assigns): 

1. WAIVE, RELEASE AND DISCHARGE Rideo from any and all liability for death, disability, personal injury, property damage, property theft and all other risks, claims or actions of any kind (including breach of contract, acts of negligence to the fullest extent permitted by law) whatsoever and however occurring, together with any legal fees incurred as a result of any such claim whether it is valid or not, which you at any time had or have as a result of or in connection with, directly or indirectly, your participation in and your travelling to and from the event.

2. INDEMNIFY AND HOLD HARMLESS Rideo from any and all liabilities, claims or actions (including negligence) whatever or however caused arising as a result of or in connection with, directly or indirectly, your participation in and travelling to and from the event and you acknowledge that you are responsible for your personal possessions and equipment during the event. If you suffer any injury or illness, you agree that Rideo may provide evacuation, first aid and/or medical treatment at your expense and that your acceptance of these terms and conditions constitutes your consent to such evacuation, first aid and/or medical treatment.  You certify that the medical information supplied by you on the registration form is true and you consent to and authorise that information to be provided to any medical practitioner, ambulance officer or any person involved or associated with any medical treatment or assistance that may be given to you as a result of your participation in the event, regardless of whether the treatment is given. 

ii. Coronavirus Procedure - PLEASE READ !!!

a. The participant must not book and must not attend a Rideo event if:

  • they have reason to believe they might be at risk of contracting the coronavirus;

  • they are unwell;

  • they have been in contact with someone may have or has the Coronavirus.

b. If you become aware or have reason to believe that you may have coronavirus then do not attend the event and contact us as soon as practicable.

1. Insurance cover

We hold public liability and professional indemnity cover through a private insurance provider and therefore it is no longer mandatory for participants to hold Cycling Australia or similar insurance cover, although it is highly recommended. We ask that participants check the scope of their cover with their private health insurance fun and/or consider taking out additional cover for mountain bike related injuries with CA. Please check out the CA membership options on their website.

2. Cancellations and Refunds

2.1 Cancellations (before Commencement Time)

Should you cancel your booking you must provide 72 hours (7 days for courses and programs including Shred Squad) notice before the Commencement Time via email in order to be eligible for a refund or credit code.  Your credit code will be for the full amount paid for the lesson and a refund will be the full amount paid for the session minus a 5% transaction fee.

2.2 Cancellations (same day or after Commencement Time)

Should you cancel your booking on the day of or after the Commencement Time you will not be issued a refund or credit. You are however able to find someone else to take your place subject to the incoming participant meeting our requirements. Read the below clause.

2.3 Booking transfers

Subject to anything contrary in these terms and conditions, you may be eligible to transfer your booking by providing notice no less than 24 hours before the Commencement Time via email.  Your notice must also include the transferee's name, age, email and best contact number.  The transferee will be required to agree to our terms and conditions and comply with any of our requirements.  

2.4 Rideo Cancellation 

Things don't always go to plan and we reserve our right to cancel (different to “postponement” described below) the Event at anytime and for any reason including unsafe weather conditions.  You will be offered the option of the full amount paid in the form of a credit code or refund.

2.5 Rideo Postponement

Things don't always go to plan and we reserve our right to postpone (different to cancelling, see above) the Event at anytime and for any reason including unsafe weather conditions.  In these situations, clauses 2.1-2.3 above apply.

2.6 Courses and Programs - Missed Lessons

If you miss a lesson that is part of a course or program, even if that missed lesson is one that has been postponed, you are not eligible for a refund or credit. Please factor in the possibility of a few postponed lessons into your planning and ability to attend the entire course or program.

2.7 Natural events and safety 

Being out in the elements such as rain, wind and colder temperatures and changing trail conditions including muddy, slippery or even dry and dusty trials are all part of this sport.  We expect participants to check the weather before the lesson and prepare accordingly including appropriate gear and supplies.  

We will only cancel a lesson if the additional risks caused by the weather cannot be mitigated.  For example, if a severe wind warning has been issued a jumping skills session may be cancelled, however a beginners session in an open area may not be.

2.8 Shred Squad Mountain Bike After School Program

As per clause 2.1 above, you must provide 7 days notice before the Commencement Time in order to be eligible for a refund or credit code.  Your credit code will be for the full amount paid for the lesson and a refund will be the full amount paid for the session minus a 5% transaction fee.

Term 1 Programs: If the entire program is not delivered before the April school holidays/Easter then you will receive a monetary credit for every undelivered lesson.

Term 4 Programs: If the entire program is not delivered before Christmas Day then you will receive a monetary credit for every undelivered lesson.

3. Safety 

3.1 Participants must inform Rideo of any known or suspected health and/or physical issues which affect, or have the chance of affecting, the participants ability to participate safely in the session.

3.2 All participants are responsible for their own bike, equipment and gear.  It is the participants responsibility to ensure that they meet the Bike and Gear Requirements.  Rideo may assist in fixing a participants bike or gear but will not be liable for any loss or damage suffered as a result of the assistance provided. 

3.3 All participants must inform Rideo of any health issues including injuries, allergies or any other condition that may affect themselves or others. Participants are responsible for their own medications such as asthma inhaler, epi-pen, insulin etc and must ensure they take medication with them to each lesson. Rideo has first aid supplies but will not be responsible and will not be held accountable if the participant forgets their medication/s.

4. Bike and Gear Requirements 

Participants must meet the minimum Bike and Gear Requirements for the safety of themselves and others in order to participate:

Bike Requirements

  • Mountain Bike.

  • Working front and rear brakes.

  • Gears in good working order.

  • Inflated tyres and off-road tread.

  • Bar ends (i.e. the end of the handlebars have caps or are covered so there is no bare metal showing).

  • No stunt pegs, kick stands or other protruding items.

  • Water source (i.e. drink bottle attached to bike via a cage or hydration pack)

  • Seat post quick release or dropper post (so we can move the seat up and down without using allen keys). 

Gear Requirements

  • Mountain bike as per above requirements.

  • Helmet (fits good, doesn’t slip off).

  • Riding shoes (grippy, enclosed sneakers or sand shoes).

  • Knee pads or pants to protect knees.

  • Water - water bottle mounted to bike frame OR hydration backpack.

  • Active sports attire including weather protective clothing (raincoat if wet and breathable top if hot)

  • Any medications such as asthma inhaler or epi-pens if required.

  • Sunscreen if its hot and sunny.

6. General

6.1 Communication

Rideo reserve the right to advertise all activity via whichever means reasonable and suitable to the business.  Whilst we try our best to provide information directly to those that requested the information first we will not be responsible for loss or disappointment if activities are advertised or released to the public or otherwise beforehand.

6.2 Mailing Lists

By signing up to our mailing list you will receive email notifications from Rideo and may unsubscribe at anytime.   We try our best to keep the information relevant to you and will not be liable for any loss or disappointment as a result of our act or omission from the information communicated in the email/s.

6.3 Notifications, notice

Unless stated otherwise, all notices and notifications referred hereto in these terms conditions must be made via the contact methods made available on the Contact Us part of our website to be deemed suitable.  

6.4 Photos and other media

If you consent to taking photos when you sign-up for a session then you agree that we can take photos and video and publish and use them any way we see fit. This includes, but is not limited to, posting on social media accounts, using on our or other websites, email and mailing lists and any materials such as flyers, posters, magazines and signs.

You must notify Rideo in writing if you wish to withdraw your consent however please note that we are unable to remove any media that has already been shared and placed online as it is out of our control.

6.4 Changes to terms and conditions

We reserve our right to amend this terms and condition at any time, without notice.  

7. Coupons, Gift Vouchers and Credit Codes

7.1 All coupons, gift vouchers and credit codes (vouchers) issued by Rideo whether for Rideo products, services or otherwise, are non-transferrable, are not redeemable for cash, trade or other form of consideration and are valid until 30 June 2024.

7.2 You can only use one voucher per transaction. For example, if you wish to book a private lesson and have a gift voucher for $50.00 and a coupon code for 25% off, you will have to choose which one you want to apply to the booking.
